The short version
We sell access to compiled public and licensed vehicle records. We work hard to make them accurate, but we don’t own the source data and can’t guarantee it’s complete. A report is research, not an inspection or a warranty. Buy one report at a time for $5, use it for your own vehicle decisions, and don’t scrape or resell it. If a report comes back empty, you’re not charged.
1. Who we are
These Terms of Service ("Terms") are an agreement between you and Vinrack, Inc. ("Vinrack", "we", "us"), a Delaware corporation, governing your use of vinrack.com, our mobile applications, our API and any report or data we deliver (together, the "Service").
By using the Service, or by purchasing a report, you agree to these Terms. If you’re using the Service on behalf of a dealership or other business, you confirm you’re authorised to bind that organisation, and "you" means that organisation.
2. What Vinrack provides
Vinrack compiles vehicle information from public government records and commercially licensed data sources, and presents it against a vehicle identification number (VIN) or a listing you point us at. The Service has two tiers:
- Free checks. Decoded vehicle specifications, factory build information, open recall notices, and pricing context drawn from current and recent listings. Unlimited, and included with your account at no charge.
- Full Reports. A paid, single-vehicle report adding listing and price history, title and ownership indicators, reported accident and odometer records, auction appearances, comparable listings and our pricing assessment.
We may add, change or retire features, data sources and report sections at any time. Where a change materially reduces what a Full Report contains, we’ll note it on this page.
3. What a report is not
This section matters more than any other, so we’ve kept it plain.
A Vinrack report reflects what has been reported to the records we can access. Events that were never reported will not appear: an unreported collision, a private repair, damage settled in cash, a mileage figure nobody wrote down. An empty section means we found nothing, not that nothing happened.
A report is therefore not a mechanical inspection, a title guarantee, an appraisal, a certification of condition, a warranty, or advice to buy or not buy a vehicle. Our pricing assessment and any suggested offer figures are statistical estimates from listing data, not valuations.
4. Payment and refunds
Full Reports are sold individually at the price shown at checkout, currently $5 per report, per vehicle. There is no subscription, no recurring charge and no bundle pricing. Payments are processed by our payment provider; we don’t store your full card details.
No hit, no charge. If we can’t return history records for the VIN you paid for, we release the authorisation or refund the charge, normally the same business day and without you asking.
Because a report is delivered immediately and cannot be returned, purchases are otherwise final. That said, if a report is materially wrong, technically broken, or clearly not the vehicle you asked for, email us within 30 days and we’ll make it right. 5. Acceptable use
Reports are licensed to you for your own vehicle purchase, sale, trade or inventory decisions. You may show a report to a seller, a buyer, a mechanic or your insurer. You may not:
- resell, redistribute, syndicate or publish our data as a product or dataset of your own;
- scrape, crawl, bulk-download or automate access outside our documented API and its rate limits;
- use the Service to build a competing vehicle-history product, or to train a machine-learning model on our output;
- use it for employment, tenancy, insurance underwriting or credit decisions about a person. Vinrack is not a consumer reporting agency under the Fair Credit Reporting Act and our reports may not be used for any FCRA-regulated purpose;
- attempt to identify, contact or harass a vehicle’s previous owners;
- remove or obscure our attribution, or misrepresent a report as issued by anyone else.
We may suspend or terminate access, without refund, for use that breaches this section.
6. Accounts and access
Using the Service requires a Vinrack account. You’re responsible for keeping your credentials secure and for activity under your account. Dealer and API access is governed by these Terms plus any order form or rate limits we agree with you.
Reports you’ve purchased remain available to you for as long as we operate the Service. We aim to keep the Service available continuously but don’t promise uninterrupted access, and we may take it down for maintenance.
7. Intellectual property
The Vinrack name, logo, interface, report design, scoring and assessment methodology are ours or our licensors’. Underlying facts drawn from public records aren’t owned by anyone, but our compilation, presentation and analysis of them are protected.
Vinrack is an independent service. We are not affiliated with, endorsed by or sponsored by Carfax, AutoCheck, Marketcheck, Manheim, any vehicle manufacturer or any dealership. Third-party names appear for identification only and remain the property of their owners.
8. Disclaimers and limitation of liability
To the fullest extent permitted by law, the Service and all reports are provided "as is" and "as available", without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.
To the fullest extent permitted by law, Vinrack will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost savings, or the cost of a vehicle, repair or transaction. Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or $50.
Some jurisdictions don’t allow certain exclusions, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.
9. Changes to these terms
We may update these Terms. When we do, we’ll change the "Last updated" date above and, for material changes, give at least 30 days’ notice before they take effect, by email if we have your address, and by notice in the product. Continuing to use the Service after that date means you accept the revised Terms. Previous versions are available on request.
